Paid promotion and music rights

Disclose paid relationships, clear the music and agree separately to advertising or reuse rights.

For Artists, rights representatives, creators and campaign reviewers

Early-access version · 2026-10-22-legal-1

Prepared October 22, 2026. This early-access version applies to new activity when it is presented and accepted where agreement is required. Earlier bookings keep their recorded terms. The availability of these pages does not enable payments or other provider features. A conditional agreement requires its applicable scope and schedules to be completed separately.

01

What this annex covers

This annex applies to commissioned promotion arranged through Popriva, operated by Lost Hills LLC, doing business as Popriva, and accompanies /artist-terms, /creator-terms and /marketplace-rules. An original TikTok video commissioned for payment is commercial promotion even when it uses a creator's usual style or the creator genuinely likes the song. Applicable advertising law, TikTok rules and the accepted brief all matter.

Campaign markets and supported locations are Worldwide, subject to applicable law, sanctions, platform eligibility and the payment provider’s supported countries; availability of an account does not guarantee eligibility to buy, accept work or receive payouts in every country; the audiences, territories and permitted uses for an individual booking must be identified in its accepted brief or separate license. Do not target a jurisdiction or undertake a regulated promotion without confirming the applicable requirements. Nothing here promises a minimum number of views, streams, sales or followers.

02

Make the paid connection clear

Creators must clearly identify payment or another material connection that could affect how viewers understand the promotion. Use the current TikTok commercial content disclosure setting appropriate to third-party promotion and add clear disclosure in the content where required by applicable law. A platform label alone is not a guarantee that every legal duty has been met.

Place disclosure where viewers encounter the promotion, in a language they understand and without needing to expand a caption or search a profile. For video, put the disclosure in the video; use visual and, where needed for the audience and format, spoken disclosure. Keep it readable and noticeable rather than hiding it among hashtags. Illustrative wording includes 'Ad — paid promotion for [artist]' or an equally clear explanation of the actual relationship. These examples are not universal legal approval.

Statements must reflect honest experience and supported facts. Do not claim personal use, independent discovery, guaranteed results or product benefits that are untrue or unsupported. Never remove a required label to improve perceived authenticity. Artists must not ask creators to hide the commercial relationship or make a scripted statement the creator cannot honestly support.

03

Artist authority and music clearance

Before commissioning work, the artist or authorized team must have the permissions required for the exact promotion. Check the sound recording and underlying composition, applicable publishing and synchronization permissions, samples, featured performers, artwork, trademarks, names and likenesses. A distribution upload, a management role or access to a social account does not alone prove ownership or authority over those rights.

Provide the correct official sound and disclose any territorial, account-type, duration or commercial-use restriction. Ensure that permissions extend to the creator's agreed use for paid promotion, including any agreed reproduction or editing. Keep evidence of authority and promptly notify Popriva and affected creators if it changes or is disputed. Creators remain responsible for their own original additions and third-party materials.

A song being searchable or playable on TikTok does not establish commercial clearance. TikTok's general music library is not automatically cleared for branded activity; commercial-library use remains subject to its applicable terms, territory and placement. If using another licensed sound or original sound, confirm the necessary commercial permissions instead of assuming that music distribution or a permission checkbox resolves them. Pause and ask for clarification when the rights chain is uncertain.

04

Creator ownership and the agreed organic post

Creators retain ownership of their original video, subject to the music and other third-party rights it contains. Artists retain their rights in their own materials. Commissioning, paying for or approving a video does not by itself transfer the creator's copyright or provide a perpetual, worldwide license to all uses.

The accepted work covers the original post on the specified creator account with the agreed sound and deliverables. Any license of music or supplied materials must come from a party with authority and extend only to the uses actually authorized. The operational license in /terms allows Popriva to administer and review the booking; it does not provide an artist a separate advertising license.

Popriva does not publicly list private creator profiles as a result of accepting a booking. A public TikTok post is separate from access to the authenticated Popriva profile and private payment information. No portfolio or testimonial permission beyond the applicable accepted agreement is implied.

05

Reposting, edits and paid advertisements need separate permission

Agree expressly before downloading and reposting a video, editing it, extracting a creator's likeness or voice, translating it, using it off-platform, boosting it, running paid advertisements, or using Spark Ads or similar account-linked advertising tools. The agreement must identify the content, authorized users, channels, territory, duration, permitted edits, compensation, expiry or revocation rules and the treatment of music and third-party rights.

Disclosure and advertising authorization are separate decisions. Read the permissions attached to brand-partner tags, authorization codes and other provider controls before enabling them. Do not enable a setting that grants advertising rights outside the agreement. Linking TikTok to Popriva, accepting a brief, tagging a brand or paying a creator does not authorize unrestricted account access or an unagreed sublicense.

No one may request a creator's password or authentication code for advertising. Use the provider's authorized permission tools only for the agreed purpose. A creator's video license cannot grant music rights the creator does not hold; the advertiser must separately verify that music clearance covers the proposed ad placement.

06

Check before accepting, publishing and approving

  • Artist: identify the authorized music and sound, intended audience, lawful deliverables, disclosure requirements, any minimum live period and the exact proposed usage rights. Do not conceal restrictions or demand unpriced additional uses.
  • Creator: review the accepted account, brief, rights information and paid-promotion obligations; confirm authority over your original footage, other people appearing and all added materials. Ask about unclear restrictions before posting.
  • Before submission: check the correct official sound, public post URL and account; visible paid disclosure; absence of unlicensed material or misleading claims; and compliance with the accepted brief. Supply accurate evidence rather than altered screenshots.
  • Reviewer: assess disclosure, sound, authorization and accepted deliverables. Request a correction or raise a rights/safety concern through the proper workflow. Do not approve missing disclosure merely because the content performs well.

07

Corrections, removals and evidence

New fixed-price bookings follow the 48-hour response, submission and valid revision periods and the conditional 72-hour review rules in /marketplace-rules. Those timers do not authorize unlawful publication. Keep the post available for the minimum live period expressly agreed in the brief, subject to necessary safety, law or platform action. Do not invent a universal additional duration.

If a sound becomes unavailable, a rights holder objects, required disclosure is missing or a platform limits the post, notify support and the other party through the booking process. Correct, restrict or remove content where necessary; do not knowingly keep unlawful material online. Preserve lawful URLs, notices and relevant records without redistributing harmful material. Do not silently substitute a different sound, account or deliverable.

Use [email protected] if the account or case tools are unavailable. Rights complaints use /copyright and safety reports use /acceptable-use. Financial consequences follow the accepted booking and /refund-policy, with evidence-based review; removal, lower reach or a platform action does not automatically determine fault, refund entitlement or reversal of already released earnings.
